Welcome to the M^0 Project Website of the M^0 Foundation which contains various information about the M^0 protocol and ecosystem ("Website"). The Website is owned and operated by M^0 Foundation, a foundation established under the laws of Switzerland under CHE-132.878.734 at registered address c/o PSC Consulting GmbH, Bergliweg 15, 6300 Zug.
The following terms of use, together with any documents incorporated by reference herein, ("Terms") apply to all visitors of the Website and are entered into by and between the visitor ("you", "your" or "User") and the M^0 Foundation ("we", "our" or "Foundation"). Please read these Terms carefully, as they govern your access to and use of the Website, including any tools and application programming interfaces (APIs) made available thereon.
By using or requesting information and/or services through our Website, you accept these Terms. The Foundation reserves the right to modify these Terms at any time at its sole discretion. In this case, we will provide notice by changing the "last updated" date above. By continuing to access or use the Website, you confirm that you accept these updated Terms.
1. Eligibility and Prohibited Jurisdictions
We render services only to eligible jurisdictions and persons. Before entering into any contractual relations with you, you will need to confirm that you represent and warrant that you (i) have the right, authority, and legal capacity to accept these Terms, (ii) will not use the Website if the laws of your countries of residency and/or citizenship prohibit you from doing so in accordance with these Terms, (iii) are not subject to personal sanctions issued by the UN, US, EU or Switzerland, (iv) access or use the Website for your own personal use, and (v) are not accessing the Website from one of the countries embargoed or restricted by the Swiss State Secretariat for Economic Affairs (SECO), including, but not limited to: Belarus, Burundi, Central African Republic, Congo, DPRK (North Korea), Guinea, Guinea-Bissau, Iran, Iraq, Lebanon, Libya, Mali, Myanmar (Burma), Republic of South Sudan, Russia, Somalia, Sudan, Syria, Ukraine, Venezuela, Yemen, or Zimbabwe ("Prohibited Jurisdictions").
2. No Interaction with the M^0 Protocol
The Website contains various information related to the M^0 protocol, which acts as a coordination layer for permissioned actors to generate fungible asset-backed stablecoins ("Protocol"). By accessing and/or using the Website, you are not interacting with the Protocol in any way. We do not and cannot control activity and data on the Protocol or the activities that users, validators, developers and other third parties may perform on the Protocol.
3. Third Party Links
The Website may contain links to websites, social media accounts, or other content that is controlled by third parties ("Links"). The Foundation is solely providing these Links to you as a convenience and for informational purposes. They do not constitute an endorsement or approval by the Foundation of any products, services or opinions. The Foundation bears no responsibility for the accuracy or legality of any content associated with the Links.
4. Intellectual Property Rights
The content provided on this Website, including text, pictures and illustrations ("Content") is subject to copyright protection and may only be used for your personal, non-commercial use. You may not use the Content for commercial purposes without our written consent. We do not guarantee that the Content does not infringe the rights of third parties.
5. Limited Warranty
The Company does not guarantee that the Website (and all Content) is free from defects, errors, bugs, and security vulnerabilities or that it will be available at any time. The access to and use of the Website is made at your own risk. 9. Governing Law and Jurisdiction
These Terms shall be governed and construed in accordance with the substantive laws of Switzerland. The application of the United Nations Convention on Contracts for the International Sale of Goods shall be excluded. Any dispute arising out of or in conjunction with these Terms shall be submitted to the exclusive jurisdiction of the ordinary courts of the city of Zug, Switzerland.
10. Class Action Waiver
To the fullest extent permitted by applicable law, the user waives the right to participate in a class action lawsuit or a class-wide arbitration against the Foundation and its affiliates in that entity (bearing the majority of the voting rights attaching to all the shares in that entity or having the power to control by any means the composition of the board of directors of that entity) or any individual or entity involved in the operation of the Network.
